A haulier holding a Community licence and legally employing a driver who is neither a national of a member state nor a long-term resident (with a status of a permanent resident of the EU) must obtain a driver attestation certificate for the driver in question.
A haulier employing a non-citizen of Latvia as a driver for international haulage in EU and EEA member states must obtain a driver attestation certificate for the driver in question.
Drivers who are non-citizens of Latvia and are employed to carry goods only in Latvia or to third countries, without crossing EU or EEA member states (i.e., to Russia or Belarus), do not require a driver attestation certificate.
The driver attestation certificate is issued for a period of no more than 5 years but not exceeding the period of validity of the employment contract, the driver’s passport, residence permit/visa, driving licence, regular training (code 95) and Community licence.
The driver attestation certificate belongs to the haulier who hands it over to the driver when the driver drives a vehicle using the Community licence issued to the haulier. The driver attestation certificate is issued along with a certified true copy of the driver attestation certificate which is kept at the haulier’s premises.
Documents to be submitted
The haulier or a person authorised by the haulier must provide the following documents to the competent authority to receive or renew a driver attestation certificate:
- an application [2];
- a certified true copy of the driver’s employment contract (or an extract showing details of the parties to the contract, responsibilities of the employee and the duration of the contract);
- a copy of the driver’s passport;
- a certified true copy of the driving licence and a copy of the driver’s qualification card or a certified true copy of the professional driving licence (except where the driving licence and qualification card were issued in Latvia);
- a certified true copy of the permanent residence permit (with the exception of non-citizens of Latvia).
